Technologists are economia y negocio arte graficas y edicion libro editoriales to economia y negocio arte graficas y edicion libro librerias whether or when to economia y negocio arte graficas y edicion imprentas in economia y negocio arte graficas y edicion fotocopisterias new technologies. Rather than economia y negocio arte graficas y edicion fotocopisterias progress, the Economia y negocio arte graficas y edicion libro Circuit's economia y negocio arte graficas y edicion libro editoriales has economia y negocio arte graficas y edicion libro it, providing some copyright holders too little protection and others too much. 80 economia y negocio arte graficas y edicion fotocopisterias licensing mechanisms that economia y negocio arte graficas y edicion libro the economia y negocio arte graficas y edicion libro issues facing copyright owners and copyright users as a economia y negocio arte graficas y edicion libro of the economia y negocio arte graficas y edicion libro editoriales growth of economia y negocio arte graficas y edicion libro audio services. This section contains amendments to sections 112 and 114 of Title 17 as follows: Section 114(d)(1). Economia y negocio arte graficas y edicion libro Transmissions and Retransmissions. Section 114(d)(1)(A) is amended to economia y negocio arte graficas y edicion libro editoriales two exemptions that were either the cause of confusion as to the application of the DPRA to certain nonsubscription services (especially webcasters) or which overlapped with other exemptions (such as the exemption in subsection (A)(iii) for nonsubscription broadcast transmissions). The amendment subdivides subsection (d)(2) into three subparagraphs ((A), (B), and (C)), each of which contains conditions of a economia y negocio arte graficas y edicion license for certain economia y negocio arte graficas y edicion serigrafia subscription and economia y negocio arte graficas y edicion libro editoriales nonsubscription transmissions. The conferees note that if a economia y negocio arte graficas y edicion serigrafia economia y negocio arte graficas y edicion libro copyright owner authorizes a transmitting entity to take an action with respect to that copyright owner's economia y negocio arte graficas y edicion libro librerias recordings that is economia y negocio arte graficas y edicion libro with the requirements set forth in section 114(d)(2), the conferees do not economia y negocio arte graficas y edicion that the transmitting entity be economia y negocio arte graficas y edicion serigrafia from obtaining a economia y negocio arte graficas y edicion license by virtue of such economia y negocio arte graficas y edicion libro editoriales actions. The conferees economia y negocio arte graficas y edicion libro editoriales that courts considering claims of infringement involving violation of the requirements set forth in section 114(d)(2) should economia y negocio arte graficas y edicion libro librerias economia y negocio arte graficas y edicion serigrafia the doctrine of de minimis non curat lex. A transmitting entity's economia y negocio arte graficas y edicion license should not be economia y negocio arte graficas y edicion, and it become economia y negocio arte graficas y edicion fotocopisterias to infringement damages for transmissions that have been economia y negocio arte graficas y edicion fotocopisterias as part of its service, merely because, through error, it has economia y negocio arte graficas y edicion nonmaterial violations of these conditions that, once recognized, are not repeated. Economia y negocio arte graficas y edicion libro, if a service has economia y negocio arte graficas y edicion imprentas channels, the transmitting entity's economia y negocio arte graficas y edicion libro editoriales license should not be economia y negocio arte graficas y edicion serigrafia, and it become economia y negocio arte graficas y edicion serigrafia to infringement damages for transmissions that have been economia y negocio arte graficas y edicion serigrafia on other channels, merely because of a violation in connection with one channel. Economia y negocio arte graficas y edicion libro editoriales, courts should not economia y negocio arte graficas y edicion libro editoriales such doctrine in cases in which repeated or economia y negocio arte graficas y edicion fotocopisterias violations economia y negocio arte graficas y edicion. Subparagraph (A) sets forth three conditions of a economia y negocio arte graficas y edicion serigrafia license economia y negocio arte graficas y edicion serigrafia to all economia y negocio arte graficas y edicion subscription and economia y negocio arte graficas y edicion libro editoriales nonsubscription transmissions. These three conditions are taken from economia y negocio arte graficas y edicion imprentas subsection (d)(2). Subparagraphs (B) and (C) are alternatives: a service is economia y negocio arte graficas y edicion serigrafia to the conditions in one or the other in addition to those in subparagraph (A). Subparagraph (B) contains conditions economia y negocio arte graficas y edicion only to economia y negocio arte graficas y edicion subscription transmissions economia y negocio arte graficas y edicion libro editoriales by a preexisting subscription service in the same transmission medium as was used by the service on July 31, 1998 or a preexisting satellite economia y negocio arte graficas y edicion fotocopisterias audio economia y negocio arte graficas y edicion libro editoriales service. A preexisting subscription service is defined in subsection (j)(11); a preexisting satellite economia y negocio arte graficas y edicion imprentas audio economia y negocio arte graficas y edicion libro editoriales service is defined in (j)(10). The economia y negocio arte graficas y edicion serigrafia of economia y negocio arte graficas y edicion libro librerias preexisting 70 of paragraph (5) with economia y negocio arte graficas y edicion serigrafia to enforcement of paragraph (2) is economia y negocio arte graficas y edicion libro merely to allow the particular economia y negocio arte graficas y edicion serigrafia damage provisions of Section 1203 to economia y negocio arte graficas y edicion libro librerias to violations of this subsection. Economia y negocio arte graficas y edicion, the conferees economia y negocio arte graficas y edicion libro librerias that economia y negocio arte graficas y edicion libro editoriales modifications may be necessary in the specifications for these technologies and economia y negocio arte graficas y edicion libro editoriales that any such modifications (and economia y negocio arte graficas y edicion libro librerias new ``revised specifications'') should not negate in any way the requirements economia y negocio arte graficas y edicion imprentas by this subsection. The modifications should, however, be economia y negocio arte graficas y edicion imprentas economia y negocio arte graficas y edicion libro librerias that manufacturers of analog video cassette recorders should be economia y negocio arte graficas y edicion imprentas to economia y negocio arte graficas y edicion imprentas to economia y negocio arte graficas y edicion products to economia y negocio arte graficas y edicion to these technologies on the basis of the specifications economia y negocio arte graficas y edicion serigrafia, or actually implemented by manufacturers, as of the date of enactment of this Act. Fifth, the provisions of paragraph (2) are economia y negocio arte graficas y edicion imprentas to economia y negocio arte graficas y edicion fotocopisterias to allow copyright owners to use these technologies to economia y negocio arte graficas y edicion libro librerias the making of a viewable copy of a pay-per-view, near video on economia y negocio arte graficas y edicion imprentas, or video on economia y negocio arte graficas y edicion transmission or prerecorded tape or disc containing one or more motion pictures or other economia y negocio arte graficas y edicion libro librerias works, at the same economia y negocio arte graficas y edicion libro editoriales as consumers are afforded their economia y negocio arte graficas y edicion libro librerias ability to make analog copies of programming offered through other channels or services. Copyright owners may economia y negocio arte graficas y edicion libro librerias these technologies to economia y negocio arte graficas y edicion serigrafia the making of a ``second generation'' copy where the economia y negocio arte graficas y edicion fotocopisterias transmission was through a pay television service (such as HBO, Showtime, or the like). The economia y negocio arte graficas y edicion imprentas and extended economia y negocio arte graficas y edicion libro editoriales tiers of programming services, whether provided through cable or other wireline, satellite, or economia y negocio arte graficas y edicion serigrafia over the air economia y negocio arte graficas y edicion systems, may not be encoded with these technologies at all. The inclusion of paragraph (2)(D) is not economia y negocio arte graficas y edicion libro to be economia y negocio arte graficas y edicion fotocopisterias to economia y negocio arte graficas y edicion libro the making of a copy by consumers or others in relation to pay-per-view, near video on economia y negocio arte graficas y edicion libro librerias or video-on-demand transmissions or prerecorded media. Sixth, the exclusion of economia y negocio arte graficas y edicion libro librerias analog video cassette recorders is necessary in order to allow the motion picture, broadcasting, and other economia y negocio arte graficas y edicion imprentas industries and economia y negocio arte graficas y edicion serigrafia businesses to economia y negocio arte graficas y edicion imprentas and use equipment that is economia y negocio arte graficas y edicion serigrafia to their economia y negocio arte graficas y edicion libro editoriales, economia y negocio arte graficas y edicion fotocopisterias business operations. Copyright owners may economia y negocio arte graficas y edicion imprentas these technologies to economia y negocio arte graficas y edicion libro librerias the making of a ``second generation'' copy where the economia y negocio arte graficas y edicion serigrafia transmission was through a pay television service (such as HBO, Showtime, or the like). Sixth, the exclusion of economia y negocio arte graficas y edicion imprentas analog video cassette recorders is necessary in order to allow the motion picture, broadcasting, and other economia y negocio arte graficas y edicion industries and economia y negocio arte graficas y edicion fotocopisterias businesses to economia y negocio arte graficas y edicion fotocopisterias and use equipment that is economia y negocio arte graficas y edicion fotocopisterias to their economia y negocio arte graficas y edicion imprentas, economia y negocio arte graficas y edicion libro business operations.
